NCEL Harley-Davidson® Win Before It Begins Promotion
Rules and Regulations
One (1) Preliminary Drawing will be conducted by the North Carolina Education Lottery (“NCEL”) using any non-winning NCEL $5.00 scratch-off ticket, on sale during the entry period of February 16 through March 16, 2009. Five (5) Preliminary Finalists will be selected from the entries received for the Preliminary Drawing. These finalists will be eligible to participate in the Final Drawing to be held at Time Warner Cable Arena in Charlotte, NC, on March 31, 2009. One (1) Grand Prize Winner from the Final Drawing will win a Harley-Davidson® Dyna® Fat Bob® motorcycle. The remaining four (4) finalists participating in the Final Drawing will receive a prize of one thousand dollars ($1,000), subject to any applicable taxes and other required withholdings.

Actual drawing dates and corresponding entry dates are subject to change at the sole discretion of the NCEL. All drawings shall be conducted in accordance with the NCEL Harley-Davidson® Win Before It Begins Drawing Procedures as established by the NCEL.
Entry Eligibility Requirements
- Entrants must be at least eighteen (18) years old to participate and are subject to all NCEL Rules and Regulations and the Lottery Act.
- A valid entry shall consist of one (1) non-winning NCEL $5.00 scratch-off ticket, on sale during the entry period of February 16 through March 16, 2009 and meeting the validation requirements of the NCEL. (See list of eligible active games below).

- Entries Received By Mail:
Players may enter the drawing by mailing a non-winning NCEL $5.00 scratch-off ticket, on sale during the entry period, with their signature, name, address and phone number printed legibly in the personal data spaces provided on the back of the ticket. Envelope Size Clarification: Each entrant must place the ticket entry in a standard business envelope (4 1/8" x 9 1/2"). Envelopes sized 4 1/2" x 9 1/2" as previously published will also be accepted. Place proper first class postage on the envelope as designated by the United States Postal Service and mail the ticket via US Mail. Tickets received in any size envelopes other than stated above will be disqualified. Tickets received at any mailing address other than that listed above or received past established deadlines for the drawing will be disqualified. Only Finalist and Alternate Finalist envelopes will be opened. Other non-eligible tickets, including winning instant or on-line ticket claims, received at the NCEL PROMO post office box will not be processed for payment and will be destroyed per the destruction schedule as established by the NCEL. Such non-eligible tickets shall also be disqualified if selected during the drawing process.
- Entries Received at Time Warner Cable Arena in Charlotte, NC:
Players may enter the drawing by depositing a non-winning NCEL $5.00 scratch-off ticket, on sale during the entry period, with their signature, name, address and phone number printed legibly in the personal data spaces provided on the back of the ticket in the secured container provided at the Harley-Davidson® Dyna® Fat Bob® motorcycle display at Time Warner Cable Arena. Drop-off entry is subject to the hours of operation and public access availability of Time Warner Cable Arena. Drop off ticket entries must be received at Time Warner Cable Arena by the designated deadline. Players are responsible for contacting the Time Warner Cable Arena for hours of operation.

- Ticket entries received past the established deadlines for the drawing will be disqualified. Other non-eligible tickets, including winning instant or on-line ticket claims, deposited in the secured container at the Harley-Davidson® Dyna® Fat Bob® motorcycle display at Time Warner Cable Arena will not be processed for payment and will be destroyed per the destruction schedule as established by the NCEL. Such non-eligible tickets shall also be disqualified if selected during the drawing process.
- Entries received after the preliminary drawing deadline shall be deemed ineligible for any drawing and shall be destroyed per the destruction schedule as established by the NCEL. Non-selected entries shall also be destroyed per the destruction schedule.
- For entries mailed, the NCEL is not responsible for lost, late, damaged, stolen, misdirected entries or entries sent to any address other than the address listed above, or for any entry that does not comply with these procedures. Postmark does not constitute satisfaction of deadline requirements. The risk of mailing entries remains with the player.
- The NCEL shall take various efforts to secure entries submitted via the secured container located at Time Warner Cable Arena. However, the NCEL and Time Warner Cable Arena are not responsible for any entries stolen from the secured container or destroyed due to fire, weather, etc.
- All contact information on the back of each entry must be legible. Non-legible tickets shall be deemed ineligible tickets.
- Drop-off entries that are ripped, stapled, taped, folded, or otherwise not in "normal" condition will be placed in a standard size envelope and included with the mail-in entries.
- Tickets determined to be in a stolen/missing inventory status or not part of a valid sold, activated or promotional NCEL inventory status will be disqualified.
Preliminary Drawing
The NCEL shall conduct one (1) Preliminary Drawing to select five (5) Preliminary Finalists for the Final Drawing. If, after selection, it is determined that any of the Preliminary Finalists or his/her entry lacks required information; or the person cannot be located; or the person has not cleared his/her debt setoff within three (3) business days of the NCEL’s notification, the ineligible Preliminary Finalist shall be replaced with, in the sequential order selected, the next Alternate Finalist.
Final Drawing Eligibility
In addition to all eligibility requirements to be selected as a Preliminary Finalist for the Final Drawing, eligible Preliminary Finalists must be in compliance with the following requirements in order to participate in the Final Drawing selection process:
- Eligible Preliminary Finalists must complete a Winner Claim Form at one of the NCEL Regional Offices or Headquarters after notification by the NCEL regarding the eligibility status. All prize winnings are subject to mandatory State and Federal Taxes and other State Withholdings. All selected Preliminary Finalists must complete prize claim paperwork and validation checks before any prizes can be awarded. Any debt set off by a Preliminary Finalist must be cleared within three (3) business days of the NCEL’s notification in order to qualify for the Final Drawing; otherwise the Finalist position will be allocated to the next qualified alternate.
- Each eligible Preliminary Finalist (or a designated proxy approved by the NCEL) must be present at Time Warner Cable Arena on March 31, 2009 (“Final Drawing Event”) as designated by the NCEL. Preliminary Finalists will be notified of the exact time of the Final Drawing Event at least three (3) business days prior to the event.
- If the eligible Preliminary Finalist is unable to be present at the Final Drawing Event, the Preliminary Finalist must execute a proxy designation form designating an individual, age eighteen (18) or older, to participate on his/her behalf. Any prize winnings resulting from the Final Drawing Event won by the proxy shall be payable to the Preliminary Finalist. The NCEL reserves the right to approve any and all proxy designations.
- If the eligible Preliminary Finalist is unable to be present at the Final Drawing Event and has failed to designate a proxy, the NCEL shall then designate a proxy to participate in the Final Drawing Event on behalf of the Entry Holder. Any prize winnings resulting from the Final Drawing Event won by the proxy shall be payable to the Preliminary Finalist.
- As determined by the NCEL, if the eligible Preliminary Finalist or designated proxy appears to be visibly impaired or under the influence of any controlled substance, the NCEL shall designate a proxy to participate in the Final Drawing Event on behalf of the Preliminary Finalist.
- All eligible Preliminary Finalists must comply with the drawing procedures as established by the NCEL for the Final Drawing.
- The Grand Prize of the Harley-Davidson® Dyna® Fat Bob® Motorcycle Prize includes applicable State and Federal withholding taxes, sales tax, dealer preparation charges and set-up fees. The NCEL is not responsible for any additional State and Federal and/or local taxes or fees. Any vehicle insurance or motorcycle license required by applicable law is the responsibility of the Grand Prize Winner. If the Winner does not possess a valid/current motorcycle license, the motorcycle must be removed by trailer equipment provided by the Winner at the Winner’s expense or be driven by a person who does possess a valid/current motorcycle license. The cost of travel to take possession of the Harley-Davidson® Dyna® Fat Bob® Motorcycle Prize shall be the responsibility of the Grand Prize Winner. The Grand Prize Winner is responsible for making all arrangement to claim the Harley-Davidson® Dyna® Fat Bob® Motorcycle Prize with the local Harley-Davidson® dealer.
Miscellaneous
Approximately sixty (60) days after the completion of the Final Drawing, the NCEL shall destroy all Alternate, non-winning and non-selected entries.
